Europe Yachts is the trading name of Cusmanich d.o.o., registered at Vrboran 37, 21000 Split, Croatia. This Privacy Policy explains what personal data we collect when you use europe-yachts.com or contact our broker desk, why we collect it, how long we keep it, and the rights you have over it under the EU General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR").

What data we collect

• Quote / wizard forms: name, email, phone, country of residence, charter dates, group size, vessel preference, budget bracket — all submitted voluntarily by you. Required to issue a quote.
• Booking forms: additionally, date of birth (charterer + skipper), sailing licence + VHF licence scan, passport scan (where the partner agency requires it under their flag-state regulations), payment-card metadata via the Stripe gateway (never the PAN itself).
• Web analytics: IP address, browser type, device class, referrer URL, pages viewed, session duration. Collected automatically by Google Analytics 4 and used to improve site navigation.

Why we use it (lawful basis under GDPR Article 6)

• Performance of the charter contract (Art. 6(1)(b)) — to issue quotes, sign booking contracts, forward licence documents to the partner agency in the country of charter (Croatia, Greece, Italy, Spain or Türkiye), arrange transfers and concierge bookings.
• Legal obligation (Art. 6(1)(c)) — VAT and accounting records retained 11 years per Croatian Tax Administration; some jurisdictions require passport-data retention.
• Legitimate interest (Art. 6(1)(f)) — site analytics and security logging, fraud prevention on the payment gateway.
• Consent (Art. 6(1)(a)) — marketing email (optional newsletter sign-up only), Facebook Custom Audience targeting, remarketing cookies. Consent is revocable at any time via the cookie banner or by emailing us.

Third-party processors we share data with

• Partner charter agencies in the country of charter — minimum data required to honour your booking (name, dates, licence, vessel). Bound by EU-standard or country-equivalent contracts.
• Stripe (Ireland) — payment processing; PCI-DSS audited.
• Google Analytics 4, Google Ads — pseudonymised analytics + remarketing under EU SCC.
• Facebook / Meta — Custom Audience and Conversion Pixel where you have consented via the banner.
• Wiener Insurance Group — payment-wire indemnity insurance on broker-handled charter bookings.
• Mailgun / transactional email provider — booking confirmations, inquiry replies.

We do not sell, rent, or exchange your personal data with parties not listed above.

Retention

• Quote inquiries that did not convert: 24 months from last contact, then anonymised.
• Charter booking records: 11 years (Croatian VAT/accounting law).
• Marketing consents and analytics IDs: until you withdraw consent or 26 months (GA4 default), whichever is earlier.

Your rights under GDPR

You have the right to: access your data (Art. 15), rectify it (Art. 16), erase it (Art. 17 — except records we are legally required to retain), restrict processing (Art. 18), data portability (Art. 20), object to legitimate-interest processing (Art. 21), withdraw consent at any time (Art. 7(3)), and lodge a complaint with the Croatian Personal Data Protection Agency (AZOP, azop.hr).

International transfers

Where partner agencies sit outside the EU (Türkiye, Caribbean for occasional charters), data transfers run under Standard Contractual Clauses (Commission Implementing Decision (EU) 2021/914) or equivalent adequacy mechanism.

Changes to this Policy

We update this Policy from time to time. The "last reviewed" date is set at deploy time; check back periodically. Material changes are notified via banner.
